Memorandum of Understanding (modification) — document template
Version 1.0 · Effective 2026-10-16 · Utah, USA
This agreement applies to the product named above and is read together with the Terms of Service. Where the two differ, this agreement governs this product. divvi is a document preparation service, not a law firm.
What it is
An agreed (uncontested) modification client chooses, before payment, how to finish:
- Memorandum of Understanding — divvi generates ONE document stating the agreed
changes in plain terms, for both parties to sign. No court forms are generated.
- File with the court — the existing court packet, unchanged.
Same price either way. A client who chose the Memorandum may later choose to file;
the court packet is regenerated without a second charge.
The template (rendered by src/lib/documents/mou-terms.ts)
Every sentence that states a fact about the case comes from the client's own
answers — the same composed provisions (composeModificationProvisions) and decree
references the court documents use. Nothing is printed that the client did not give.
- Parties and case. The two parties' names; the original case number, county
and decree date where the client gave them (each omitted, never invented, when
not given).
- What this is. The parties have agreed to change the terms of their decree
described below, and this memorandum records that agreement in plain terms.
- The agreed changes. One numbered item per composed provision, in the same
wording as the court documents, with the decree paragraph it changes (and that
paragraph's current text) where the client identified one.
- When it takes effect. On the date the second party signs it.
- This is not a court order. The memorandum does not change the court's order.
The existing decree stays in effect, and the court can enforce only what that
order says, until a judge signs an order modifying it. Either party may later
file these changes with the court and ask a judge to approve them.
- Signatures. A signature and date line for each party.
